Probate Application Fees Have Changed

In the News... Probate Application Fees Have Changed

Recent changes announced by the Ministry of Justice mean that probate application fees have increased from July 2026. The changes form part of a wider update to court and tribunal fees across England and Wales.

What is Probate?

Probate is the legal process of dealing with someone's estate after they have passed away.

If a person owned property, money or other assets in their sole name, it may be necessary to obtain a Grant of Probate (or Letters of Administration if there isn't a Will) before the estate can be administered.

This process can include:

  • Identifying and valuing assets
  • Paying any outstanding debts
  • Settling inheritance tax where applicable
  • Collecting assets
  • Distributing the estate to beneficiaries

Why Does This Matter?

While the increase in the probate application fee won't affect every estate, it serves as a timely reminder of the importance of planning ahead.

Having a professionally prepared Will can make the administration of an estate clearer and help ensure your wishes are properly documented.

Although a Will doesn't always remove the need for probate, it can often make the process more straightforward for the people you leave behind.
