Registration of an Enduring Power of Attorney (EPA)
Enduring Powers of Attorney could no longer be created after 2007, when they were replaced by Lasting Powers of Attorney (LPA). However, this only applied to new LPAÍs and any existing EPAÍs already in existence before 2007 remain valid.
If you or someone close to you has an existing EPA then you need to be aware of the procedure for activating the powers in the event that the person loses mental capacity and needs someone else to look after their finances and property. When this happens the appointed attorneyÍs should proceed to register the EPA with the Office of the Public Guardian.
Here at Norrie Waite & Slater we can help you with the registration as well as giving you advice on how the EPA can be used.
We can also advise you on any other aspect of EPAÍs, including where you are concerned that someone appointed as an attorney may not be acting in the best interests of the donor. In this case it may be possible to have them removed as an attorney.
